Definition
Cookies are small text strings that websites visited by users send to their terminal device (usually to the browser), where they are stored to be retransmitted to the same sites upon subsequent visits by the same user. During navigation on a site, users may also receive cookies on their terminal device that are sent from different sites or web servers (so-called “third parties”), on which some elements may reside (such as images, maps, sounds, specific links to pages of other domains) present on the site they are visiting.
Cookies, usually present in users’ browsers in very large numbers and sometimes with characteristics of broad temporal persistence, are used for different purposes: execution of computer authentication, session monitoring, storage of information on specific configurations concerning users accessing the server, etc.
In order to achieve proper regulation of such devices, it is necessary to distinguish them since there are no technical characteristics that differentiate them from one another based on the purposes pursued by those who use them. The legislator has also moved in this direction, who, in implementation of the provisions contained in Directive 2009/136/EC, has attributed the obligation to acquire prior and informed consent from users to the installation of cookies used for purposes other than purely technical ones (cf. art. 1, paragraph 5, letter a), of Legislative Decree May 28, 2012, no. 69, which amended art. 122 of the Code).
In this regard, and for the purposes of this provision, two macro-categories are therefore identified: “technical” cookies and “profiling” cookies.
a. Technical Cookies
Technical cookies are those used solely for the purpose of “carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such service” (cf. art. 122, paragraph 1, of the Code).
They are not used for further purposes and are normally installed directly by the owner or operator of the website. They can be divided into navigation or session cookies, which guarantee normal navigation and use of the website (allowing, for example, to make a purchase or authenticate to access restricted areas); analytics cookies, assimilated to technical cookies where used directly by the site operator to collect information, in aggregate form, on the number of users and how they visit the site itself; functionality cookies, which allow users to navigate according to a series of selected criteria (for example, language, products selected for purchase) in order to improve the service provided to them.
For the installation of such cookies, prior consent from users is not required, while the obligation to provide information pursuant to art. 13 of the Code remains firm, which the site operator, if using only such devices, may provide in the manner deemed most appropriate.
b. Profiling Cookies
Profiling cookies are aimed at creating profiles related to users and are used for the purpose of sending advertising messages in line with preferences expressed by users during web navigation. Due to the particular invasiveness that such devices may have within users’ private sphere, European and Italian regulations require that users must be adequately informed about their use and thus express valid consent.
Art. 122 of the Code refers to them where it provides that “storage of information in the terminal equipment of a contracting party or user or access to information already stored is permitted only on condition that the contracting party or user has expressed consent after being informed in the simplified manner referred to in article 13, paragraph 3” (art. 122, paragraph 1, of the Code).
